These Customer Terms of Service (the “Terms”) govern your use of the Fuel Taxi platform (the “Platform”), including the Fuel Taxi mobile application, website at fueltaxi.com, and related services. By creating an account or using the Platform, you agree to be bound by these Terms.

1. About Fuel Taxi
Fuel Taxi is a technology marketplace platform that connects customers with independent local fuel delivery businesses (“Fuel Pros”). Fuel Pros are independent operators who own and operate their own vehicles, employ their own drivers, and perform fuel deliveries directly to customers.

2. Eligibility
To use the Platform you must be at least eighteen (18) years of age and capable of entering into a legally binding agreement. By creating an account you represent that you meet these requirements.
3. Your Account
3.1 Account Creation
You agree to provide accurate, current, and complete information when creating your account, including your name, contact information, payment method, and any vehicle or property information needed to complete deliveries. You are responsible for maintaining the accuracy of this information.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Fuel Taxi immediately if you believe your account has been accessed without authorization.
3.3 Account Termination
Fuel Taxi may suspend or terminate your account for violation of these Terms, fraudulent activity, abusive conduct, or other circumstances that warrant termination. You may close your account at any time through the Platform.
4. Placing Orders
4.1 Order Process
When you place an order, you select a Fuel Pro, choose your delivery options (timing, fuel type, quantity, vehicle), and authorize payment. Once you confirm your order, you are entering into a transaction with the Fuel Pro for the requested delivery service.
4.2 Order Acceptance
Some Fuel Pros use auto-acceptance, meaning your order is confirmed immediately. Others require manual review and may decline orders. The Platform will clearly indicate which mode applies before you submit your order. If your order is declined, you will be notified and any payment authorization will be released.
4.3 No Guarantee of Availability
Fuel Taxi does not guarantee that any Fuel Pro will be available at any given time or that any specific order will be fulfilled. Availability depends on the Fuel Pro’s capacity, schedule, and operational status.
5. Pricing + Payment
5.1 Pricing
Prices are set by each Fuel Pro and may include fuel costs, delivery fees, service fees (if any), platform fees, and applicable taxes. All charges are clearly itemized at checkout before you confirm your order.
5.2 Platform Fee
Fuel Taxi charges a four percent (4%) platform fee on each transaction. This fee is shown as a line item at checkout and is included in your total.
5.3 Pre-Authorization
When you place an order, your payment method is pre-authorized for an estimated amount that includes the fuel cost, delivery fee, platform fee, and a buffer to account for actual gallons delivered. This is a hold, not a charge. The hold ensures your delivery can be completed within the authorized amount.
5.4 Final Charge
Upon completion of your delivery, your payment method is charged the actual amount based on gallons delivered, applicable fees, and any tip you choose to add. The unused portion of the pre-authorization hold is released back to your payment method according to your card network’s timing (typically same day for debit cards, 3–5 business days for credit cards).
5.5 Tips
You may add a tip for your driver at checkout or after delivery. One hundred percent (100%) of tips are passed through to the driver.
5.6 Failed Delivery Fees
If a delivery cannot be completed because you are not accessible, your vehicle cannot be located, you cancel after the driver is en route, or for similar reasons within your control, the Fuel Pro’s configured failed delivery fee may apply. Failed delivery fee terms are disclosed on the Fuel Pro’s store page and at checkout.
6. Cancellations + Refunds
6.1 Customer Cancellation
You may cancel an order before the driver accepts it for full refund. After driver acceptance but before en route, cancellation may be subject to a fee per the Fuel Pro’s rules. After the driver is en route, cancellation requires contacting the Fuel Pro directly and may result in a full failed delivery fee.
6.2 Fuel Pro or Platform Cancellation
If your order is cancelled by the Fuel Pro or by Fuel Taxi due to circumstances outside your control, you will receive a full refund of all charges including platform fees.
6.3 Refund Processing
Refunds are processed to your original payment method and typically appear within 3–5 business days depending on your card network.
7. Dispute Process
7.1 Contact the Fuel Pro First
If you have a problem with a delivery, contact your Fuel Pro through the in-app messaging system. Most issues can be resolved directly between you and your Fuel Pro.
7.2 Escalating to Fuel Taxi
If your Fuel Pro does not respond or cannot resolve the issue, you may escalate to Fuel Taxi through the Help & Support section of the app or the Fuel Taxi message thread. Fuel Taxi will review the situation and respond within twenty-four (24) hours for non-urgent matters.
7.3 Fuel Taxi’s Role in Disputes
Fuel Taxi reviews escalated disputes using order records, delivery photos, GPS data, payment records, and message history. Fuel Taxi may issue a refund, mediate between you and the Fuel Pro, or determine the dispute does not warrant action. Fuel Taxi’s decisions are made in good faith based on available evidence.
7.4 Chargebacks
If you file a chargeback with your bank, your Fuel Taxi account may be temporarily suspended pending investigation. Chargebacks should be a last resort after attempting to resolve issues through the Platform. Frivolous or fraudulent chargebacks may result in account termination.
8. Customer Responsibilities
8.1 Accurate Information
You are responsible for providing accurate vehicle, equipment, and delivery location information. Incorrect information that prevents successful delivery may result in failed delivery fees.
8.2 Accessibility
You are responsible for ensuring your vehicle or equipment is accessible to the driver during the delivery window. This may include providing access codes, unlocking gates, ensuring the fuel door is openable, and being available to assist if needed.
8.3 Sufficient Quantity Authorization
You are responsible for ordering a sufficient quantity to cover your fueling needs. The pre-authorization hold limits the maximum gallons that can be delivered. If your authorized amount is reached before your tank is full, the driver will stop fueling and you will not be charged for additional fuel.
8.4 Conduct
You agree to treat drivers, Fuel Pros, and Fuel Taxi staff with respect. Harassment, threats, or abusive behavior will result in account suspension or termination.
9. Environmental + Operational Liability
You acknowledge that fuel delivery involves the handling of hazardous materials. The Fuel Pro fulfilling your order is solely responsible for the safe handling, transportation, and dispensing of fuel and for any environmental or operational incidents arising from the delivery. Fuel Taxi is not the operator and bears no liability for fuel handling incidents. In the event of a spill, leak, injury, or property damage during a delivery, the Fuel Pro is the responsible party.
10. Privacy
Your use of the Platform is also governed by the Fuel Taxi Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what information we collect, how we use it, and with whom we share it.

11. Call Recording
Calls between you, your Fuel Pro, and your driver that are placed through the Fuel Taxi platform may be recorded. Recordings are used for quality assurance, dispute resolution, and safety purposes. By using the Platform you consent to such recording. An automated voice notification is played at the start of each call to confirm recording is active.
12. Limitation of Liability
12.1 Liability Cap
To the maximum extent permitted by law, Fuel Taxi’s total liability to you for any claim arising out of or related to these Terms, the Platform, or any transaction is limited to the amount of platform fees you paid to Fuel Taxi in the three (3) months immediately preceding the event giving rise to the claim.
12.2 Exclusion of Damages
To the maximum extent permitted by law, Fuel Taxi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation lost profits, lost data, or loss of goodwill.
12.3 As Is
The Platform is provided “as is” without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. Dispute Resolution
13.1 Informal Resolution
Most disputes can be resolved informally. We encourage you to contact Fuel Taxi support before pursuing formal action.
13.2 Binding Arbitration
If informal resolution fails, you and Fuel Taxi agree that any dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Milwaukee, Wisconsin or by videoconference.
13.3 No Class Actions
You agree to bring any disputes only on an individual basis and not as part of a class action or representative proceeding.
13.4 Governing Law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of laws principles.
14. General Provisions
14.1 Changes to These Terms
Fuel Taxi may update these Terms from time to time. We will notify you of material changes through the Platform or by email. Continued use after the effective date of changes constitutes acceptance.
14.2 Entire Agreement
These Terms, together with the Privacy Policy and any other documents incorporated by reference, constitute the entire agreement between you and Fuel Taxi.
14.3 Severability
If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
